Swimways Sues Aqua Leisure and Bestway for Patent Infringement
VIRGINIA BEACH, Va.–(BUSINESS WIRE)–Swimways Corporation today announced that the company filed lawsuits
against Aqua Leisure Industries, Avon, Mass., and Bestway Global Holding
Company, Phoenix, Az. The lawsuits were filed concurrently in the United
States District Court for the Eastern District of Virginia in Norfolk,
Virginia.
The lawsuits are based on several U.S. Patents in the Spring Float®
patent portfolio (see patents.swimways.com/springfloat), which protect
the innovative design of the Spring Float® line of products, a top
selling brand of fabric and mesh-covered pool floats. Swimways Corp.
filed the lawsuits to protect the design and features of the Spring
Float Original, Spring Float Recliner, Spring Float Papasan, Spring
Float SunDry, Spring Float SunSeat, Spring Float SunTube Lounger and
Spring Float Kids Boat. The Spring Float line was introduced by Swimways
in the U.S. in 2002 and has become one of the top selling pool float
lines in the United States.
Aqua Leisure has been selling floats that infringe several Swimways
patents under the brand names ”Waterlife,” “Aqua,” “Dolfino,” and “Aqua
Leisure,” including products such as the Waterlife Deluxe Comfort
Lounge, Aqua Ultimate Dream Recliner, Dolfino Ultimate Multi-Position
Recliner, and Aqua Deluxe Aqua Chair. Bestway has been infringing
several patents under the brand “Ozark Trail” and the Bestway-branded
Aqua Lounge.
